Regulatory actions

- Maryland Attorney General, Consumer Protection Division (settlement): The Division alleged unlicensed lending and alleged that from Dec 2019 to Oct 2023 Brigit misled consumers about 'Instant Cash'. The alleged conduct was undisclosed fees for instant access, advertised amounts consumers might not qualify for, and refusing to cancel subscriptions while an advance was unpaid. Brigit pays $600,000 to the Division and must disclose fees and eligibility, let consumers cancel at any time, and comply with Maryland's lending and EWA laws. Status: Resolved by settlement (assurance) announced 2026-10-27. Source
- Minnesota Attorney General (complaint): AG Keith Ellison sued Brigit. He alleges that its 'Instant Cash' advances are payday loans made as an unlicensed, unregistered consumer small-loan and short-term lender under Minnesota's payday lending laws. According to the AG, APRs regularly exceed 300% and some exceed 700%, against a 50% APR cap for consumer short-term lenders, and the rates are never disclosed. Status: Filed 2026-06-10. No resolution found on ag.state.mn.us as of 2026-11-08. Source
- Massachusetts Division of Banks (settlement agreement): Brigit allegedly acted as a third-party loan servicer in Massachusetts without registration from at least July 2021, in violation of M.G.L. c. 93 s. 24A. It paid $1,900,000 to the Division of Banks Settlement Trust and agreed to cease unlicensed activity, without admitting the allegations (Docket 2026-002). The agreement notes Brigit applied for registration on or about 2025-06-23. Status: Resolved by settlement 2026-05-05. Source
- FTC (settlement (complaint + stipulated order)): The FTC filed a complaint and a proposed stipulated order in the U.S. District Court for the Southern District of New York (No. 1:23-cv-09651). It alleged that Brigit's promises of 'instant' cash advances of up to $250 were deceptive and that it locked consumers into a $9.99 monthly membership they could not cancel. Brigit agreed to pay $18 million for refunds, stop the deceptive claims and end cancellation barriers. The court entered the order on 2023-11-14. Status: Order entered November 14, 2023. The FTC has since sent refunds in two rounds (November 2024 and May 2026). Source
